presumably be taken in respect of such cases under Article 38(1)(a) the shipments to the destination of Hong Kong appear all to have been made according to the lists furnished by the consular officers in the Persian Gulf before the date of the Ordinance. The situation will now however be greatly changed

by the passing of the new Ordinance of the 28th August last: Nemazee returns to the Colony, and attempts to continue his operations, it should be possible for the Governor to take action

at once.

As regards the Governor's proposal not to strike Nemazee's name off the Commission of the Peace but to invite him to resign, Mr. Henderson is afraid that this will give the impression of weakness on the part both of the Colonial and of the Home Govern-

ments in view of the fact that the character of Nemazee's

operations is perfectly wellknown to the Governments of other countries and to the public: but he does not wish to press his view if in all the circumstances Mr. Thomas considers the course suggested by the Governor the best.

As regards paragraph 4 of the Governor's letter, Mr. Henderson's proposal was not limited to applications for passports

r visas to proceed to Persia. He thinks no facilities should be i given to lenazee or his family or firm to proceed to any place where he would be likely to be engaged in carrying on the traffic in question e.g. Shanghai, Macao etc.

As regards paragraph of the Governor's letter, the Secre- tary of State has no observations or suggestions to make.
